Parmi ces institutions figurait le notaire, qu\u2019il qualifiait d\u2019important et de n\u00e9cessaire dans le syst\u00e8me de l\u2019\u00c9tat. La r\u00e9solution par laquelle Ioannis Kapodistrias a r\u00e9glement\u00e9 l\u2019institution notariale a \u00e9t\u00e9 \u00e9mise le 11.2.1830 et publi\u00e9e sous le num\u00e9ro 67 le 23.3.1830 dans la Gazette g\u00e9n\u00e9rale de Gr\u00e8ce, dans la feuille n\u00b0 25 (ann\u00e9e E)<sup>[1]<br \/><br \/><\/sup>[1] \u00ab\u00a0G. Il est nomm\u00e9 \u00e0 titre permanent par le ministre de la Justice et a pour mission de prot\u00e9ger l\u2019int\u00e9r\u00eat public, la s\u00e9curit\u00e9 publique et la politique fiscale et sociale.<br \/>Le notaire est un officier public non r\u00e9mun\u00e9r\u00e9 (article 1 \u00a7 1 du Code du Notariat). En tant qu\u2019agent public, il jouit d\u2019une ind\u00e9pendance officielle, professionnelle et fonctionnelle, mais cela ne signifie pas qu\u2019il n\u2019est pas soumis \u00e0 un contr\u00f4le. Son travail est soumis \u00e0 trois contraintes : la loi, la morale et sa conscience, puisque, selon l\u2019article 5 du Code des notaires, le notaire \u00ab doit s\u2019abstenir de r\u00e9diger tout acte contraire aux lois et aux bonnes m\u0153urs \u2026 et doit remplir ses fonctions en toute conscience et impartialit\u00e9
